The short version

FacePause is a Mac app I built solo. When you buy a license, you get to use it on your own Macs — that's it. You don't get to redistribute it, resell it, or pull it apart and ship it as something else. It's a one-time purchase, not medical software, and comes "as is" — but if it doesn't work, the refund policy has you covered.

1. Who you're buying from

FacePause is operated by Radoslaw Latarski (sole proprietorship), based in Warsaw, Poland. Throughout these terms, "we", "us", and "our" refer to the operator. "You" means the person purchasing or using the app.

Payments are processed by Lemon Squeezy (Sold through Link, LLC), who acts as the Merchant of Record for your purchase. Lemon Squeezy's Buyer Terms & Conditions and Privacy Policy apply to the transaction itself (taxes, invoicing, payment method handling, fraud prevention). These terms apply to your use of the FacePause software.

2. Acceptance of these terms

By downloading, installing, activating, or using FacePause, you agree to these Terms & Conditions, the Privacy Policy, and the Refund Policy. If you don't agree, don't install or use the app.

3. Eligibility

To purchase or use FacePause you must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into a binding agreement. By purchasing, you represent that you meet these requirements and that all information you provide during checkout is accurate.

4. License to use FacePause

When you complete a valid purchase, we grant you a personal, non-exclusive, non-transferable, non-sublicensable license to install and use FacePause on Macs you personally own or control, for your own use, for as long as the app continues to function on your system.

One license is for one person. If you need to install FacePause on someone else's Mac, they need their own license.

5. What you can't do

You don't get permission to:

  • Resell, sublicense, rent, lease, share, or redistribute FacePause or your license key.
  • Post your license key publicly or share it with anyone — keys tied to suspicious activity, sharing, or distribution may be deactivated.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code, except where this restriction is explicitly prohibited by applicable law (for example, the limited interoperability rights under EU law).
  • Modify FacePause or build derivative works based on it.
  • Remove or alter any copyright, trademark, or other proprietary notices.
  • Use FacePause to do anything illegal, harmful, infringing, or that violates someone else's rights.
  • Use FacePause in violation of the export and sanctions rules in section 11.

6. Intellectual property

FacePause, the FacePause name, the website, all visual design, source code, assets, and accompanying materials are owned by Radoslaw Latarski and are protected by copyright and other applicable laws. Nothing in these terms transfers ownership to you — you only get the license described in section 4.

Third-party components (such as Apple's Vision framework, system frameworks, and any open-source libraries) remain governed by their respective licenses.

7. Pricing, payments, and taxes

Prices are shown on facepause.app and on the Lemon Squeezy checkout page at the time of purchase. The price displayed at checkout is the price that applies to your order. Lemon Squeezy collects and remits applicable sales tax, VAT, GST, and similar consumption taxes as the Merchant of Record.

We may change pricing at any time. Because FacePause is a one-time purchase, any price change affects only new orders placed after the change — it does not retroactively affect licenses already purchased. If we ever introduce promotions, discounts, or different license tiers, the terms of each will be made clear at checkout.

Chargebacks: if you have an issue with a purchase, please contact us first at contact@facepause.app — see the Refund Policy. Filing a chargeback without first attempting to resolve the issue, or filing a chargeback that we reasonably determine to be fraudulent or abusive, may result in deactivation of your license and a permanent ban from future purchases.

8. Updates and support

I push updates as the app evolves — bug fixes, model improvements, compatibility with new macOS versions. Updates are included with your license. I do not promise a specific update cadence or that any particular feature will be added or kept.

Support is handled over email at contact@facepause.app. I respond as a solo operator — usually within 1–2 business days.

9. FacePause is not medical software

FacePause is a productivity and wellbeing tool. It estimates signs of screen fatigue (posture drift, blink rate, focus distance) and nudges you to take breaks. It is not a medical device. It does not diagnose, treat, prevent, or cure any condition. If you have eye strain, posture problems, or any health concerns, consult a qualified professional.

10. Acceptable use

You agree not to use FacePause in any way that violates any applicable law or regulation; that infringes the rights of any third party; that interferes with or disrupts the integrity, security, or performance of the software; or that attempts to gain unauthorized access to our systems, license servers, or other users' data.

11. Export controls and sanctions

FacePause may be subject to export control and economic sanctions laws — including those of the European Union, the United States (including OFAC regulations), the United Kingdom, and other applicable jurisdictions. By purchasing or using FacePause, you represent and warrant that:

  • You are not located in, ordinarily resident in, or a national or government official of any country or territory subject to comprehensive sanctions (currently including Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, and Luhansk regions of Ukraine, and any other comprehensively sanctioned region as updated from time to time).
  • You are not listed on, owned by, or acting on behalf of any party listed on the U.S. Treasury Department's Specially Designated Nationals (SDN) List, the EU Consolidated List of Sanctions, the UK Sanctions List, or any equivalent restricted-party list.
  • You will not use, export, re-export, transfer, or make available FacePause — directly or indirectly — to any such country, region, or party, or for any purpose prohibited by applicable export control or sanctions law (including nuclear, chemical, or biological weapons proliferation, or missile technology).

If you become aware of a violation of this section, stop using FacePause and notify us immediately. We may terminate your license if these representations are inaccurate or if continued service would violate applicable law.

12. Disclaimers

To the maximum extent permitted by applicable law, FacePause is provided "as is" and "as available", without warranties of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, fully accurate in every detection, or compatible with every macOS configuration.

Nothing in this section limits any rights you have as a consumer that cannot be waived under your local law.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Radoslaw Latarski be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or in connection with your use of FacePause, even if advised of the possibility of such damages.

Our total cumulative liability for any claim relating to FacePause will not exceed the amount you actually paid for your license.

These limitations do not apply to liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for intentional misconduct).

14. Termination

Your license remains in effect until terminated. We may terminate or suspend it if you materially breach these terms — for example, by sharing your key publicly, attempting to crack the app, filing an abusive chargeback, violating section 11, or using FacePause unlawfully. On termination, you must stop using FacePause and uninstall it. Sections that by their nature should survive termination (IP, disclaimers, liability, export, governing law) will survive.

You can terminate at any time by uninstalling the app. Refund eligibility is governed by the Refund Policy.

15. Privacy

How we handle data is described in the Privacy Policy. The short version: camera processing happens entirely on your Mac. No frames, images, or biometric data are ever sent to us or anyone else.

16. Changes to these terms

We may update these terms from time to time — for example, to reflect changes in the product, payment processing, or applicable law. The "Last updated" date above shows when the current version took effect. If a change materially affects your rights, we'll make a reasonable effort to flag it (email, if we have one for you, or an in-app notice). Continued use of FacePause after a change means you accept the updated terms.

17. Governing law and jurisdiction

These terms are governed by the laws of Poland, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these terms will be submitted to the exclusive jurisdiction of the courts competent for Warsaw, Poland.

If you are a consumer based in the European Union, this clause does not deprive you of the protections granted by mandatory consumer law in your country of residence.

18. Miscellaneous

  • Entire agreement. These terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding FacePause.
  • Severability. If any provision is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these terms without our consent. We may assign them as part of a sale or transfer of the FacePause business, on notice.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (network outages, third-party service failures, natural events, government actions, etc.).
